Distracted Driving Cases Significantly Increased the Need for Texting While Driving Experts

For years, Data Specialist Group (DSG) has been Tampa Bay’s leading digital forensics company when it comes to smartphone forensics and mobile device data recovery. We have numerous certifications in mobile forensics including iOS Forensics, Android Forensics, and “Call Detail Records”, to name a few. We are currently the only cell phone forensics company in Florida that is capable of in-house microscopic board repair to facilitate mobile device data recovery from water and fire damaged smartphones. It’s no surprise that we have also become the experts that litigators rely on for distracted driving cases. DSG’s mobile forensics lab is unmatched when it comes to our ability to forensically analyze cellphones believed to have been utilized during a motor vehicle accident. All of our findings are presented in an easy to understand chronological format with all of the necessary metadata.

Prosecuting and defending texting and driving cases is very complicated. These cases require an expert that is not only capable of testifying about the digital artifacts found in the mobile device, but also able to prove or disprove if someone was texting, tweeting, emailing or browsing. The expert you require needs the ability to understand all of the technologies associated with digital communications, cell towers, 911 call centers, time servers, and computer networks. Our experts have testified at jury trials and are fully capable of translating complex technical jargon into layman’s terms.

As experts in the field of digital forensics, Data Specialist Group has been increasingly called upon to investigate cases where cell phones were used to commit crimes. Currently, we are working on a case where a person was distracted while driving, and inadvertently crashed into an unsuspecting victim. Using our state-of-the-art crime lab, we were able to find that the person was indeed texting and driving.

Unfortunately, these are becoming the great bulk of our forensic cases.

The Florida Department of Safety and Motor Vehicles reported more than 45,000 distracted driving crashes in 2015. The three leading counties were Orange County (5506), Miami-Dade (4445), and Hillsborough (3896). As a reult of these distracted driving crashes, there were more than 39,000 injuries and 214 deaths in Florida alone. These statistics become much more staggering if we consider the whole of the United States, where 9 Americans are killed every day from distracted driving accidents. These were injuries and deaths that could have been prevented by simply focusing on the road.

To avoid distracted driving, It is important to understand the different ways a driver could become distracted:

Visual: Taking your eyes off the road.

Manual: Taking your hands off the steering wheel.

Cognitive: Thinking about anything other than driving.

Interestingly enough, texting requires all three types of distraction. This means that texting and driving could not possibly be more dangerous! However, texting and driving is not the only way phones could be used to become distracted while driving. Answering phone calls, talking on the phone, and even glancing at notifications on our phones are causes for distracted driving.

One study revealed that on average, a driver takes their eyes off the road for 4.6 seconds to text. If we consider the speed of the vehicle they are driving, let’s say, 55mph, they have driven the length of a football field before they look up at the road!

With the increased pace of life, and the need to be connected overshadows the danger of distracted driving, we foresee that these types of cases will become more prevalent. It is necessary for the public to know that if they are a victim of a person that is distracted while driving, the experts at Data Specialist Group can help.
